A reliable and secure handling of personal data is very important to us. Therefore, we adhere to the provisions of the EU General Data Protection Regulation (GDPR/ NL: „AVG“ / DE: „DSG-VO“), the Data Protection Act of North Rhine-Westphalia („DSG NRW“), as well as the other corresponding federal law, state law and European regulations. In this data protection declaration, we would like to inform you in detail about the processing of your personal data.

Personal data is any data that can be associated with you personally, e.g. name, address, email addresses or user behavior. For the other terms used below, such as „controller“ or „data processor“, please refer to the list of definitions in Article 4 of the GDPR.

2. elicitation, processing and use of personal data

We only capture, process and/or use personal data if you have consented or if this is permitted by law.  This „prohibition subject to consent“, which applies in data protection law, means that processing may only take place on the basis of an authorization. The most important and relevant authorizations can be found in Article 6(1) DS-GVO. These relate in particular to the case

– that the data subject has given his/her consent, cf. Art. 6 Para. 1(a) in conjunction with Art. 7 DS-GVO,

– that the processing of your data is necessary for the fulfillment of our contractual obligations, cf. Art. 6 Para. 1 lit. b DS-GVO,

– or that the processing is based on our legitimate interests (e.g. increase of economic efficiency, analysis and further development of our products), cf. Art. 6 Para. 1 lit. f DS-GVO.

3. Types of the data that are collected, processed and used

In case the website is used informative without registration or transmitting further information to us, we only collect the personal data that your browser transmits to our server. When you access and use our website, our webserver automatically collects the following data in accordance with Art. 6 (1) lit. f DS-GVO, which are technically necessary to display our website to you and to ensure its stability and security:

– IP browser type/version

– Operating system used

– Referrer URL (the previously visited page)

– URL of the retrieved file

– IP address of your end device

– Date and time of server request

– HTTP status code

We use this information exclusively for optimization and error analysis purposes. They are not compared with other data or passed on to third parties, even in excerpts. We reserve the right to check this data retrospectively in case of suspicion of illegal use of our website and to pass it on to authorized third parties. The data will be automatically deleted after 60 days at the latest.

4. Purpose of collection, processing or use of personal data

We collect, process or use the personal data provided by you to enable you to use our website and to improve the user-friendliness of our website. The legal basis is art. 6 (1) (f) DS-GVO. In addition, the data you provide when you contact us by e-mail (your e-mail address, name, telephone number and other data) will be stored by us in order to process and answer your questions; the legal basis is Art. 6 (1) lit. f DS-GVO.

We delete the data obtained in this context after its storage is no longer necessary for the performance of the contract and no legitimate interests on our part or legal retention obligations oppose a deletion.

You have the following rights towards us with respect to personal data concerning you:

– Right to information in accordance with Art. 15 DS-GVO,

– Right to correction or deletion of data pursuant to art. 16 DS-GVO or art. 17 DS-GVO,

– Right to restriction of processing in accordance with art. 18 DS-GVO,

– Right to data portability in accordance with art. 20 DS-GVO,

– Right to object to processing in accordance with Art. 21 DS-GVO.

You also have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data by us. The competent authority is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Postfach 20 04 44, 40102 Düsseldorf.

6. RIGHT TO OBJECT

INSOFAR AS WE BASE THE PROCESSING OF YOUR PERSONAL DATA ON THE BALANCING OF INTERESTS PURSUANT TO ART. 6 ABS. 1 LIT. F DS-GVO, YOU MAY OBJECT TO THE PROCESSING. IN EXERCISING SUCH AN OBJECTION, WE WILL ASK YOU TO EXPLAIN THE REASONS WHY WE SHOULD NOT PROCESS YOUR PERSONAL DATA AS WE HAVE DONE. IN THE EVENT OF YOUR JUSTIFIED OBJECTION, WE WILL REVIEW THE SITUATION AND EITHER CEASE OR MODIFY THE DATA PROCESSING OR SHOW YOU OUR COMPELLING LEGITIMATE GROUNDS ON THE BASIS OF WHICH WE WILL CONTINUE THE PROCESSING.

YOU MAY OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSES OF ADVERTISING AND DATA ANALYSIS. YOU MAY INFORM US OF YOUR OBJECTION TO ADVERTISING USING THE CONTACT DETAILS SET OUT IN SECTION 1.

7. amendments of the data protection declaration

We reserve the right to amend this data protection declaration at regular intervals in line with the underlying processes. We will inform you of any changes to the Data Privacy Statement at www.dnjw.eu.
